PREETI G. SHAH

SHAREHOLDER

Preeti G. Shah joined Kegel, Tobin & Truce in 1989, becoming a partner in 1994. Ms. Shah's practice reflects a particular emphasis on the unique aspects of representing homeowner policies where claims of injury are filed by those performing work on the homeowner's property.

She has procured several Take Nothings on homeowner issues.  In the case of Ramiro Haro v. Kenneth Nepove, Case No. MON 0240293, after losing at the Trial level, she was successful in procuring an Opinion & Order Granting Reconsideration & Decision After Reconsideration where the WCAB found that applicant was not an employee of the homeowner under Labor Code Section 3352(h). 

She has successfully tried AOE/COE issues and won cases raising a defense in psychiatric issues.  In the case of Daisy Zayas v. TWA, Case No. VNO 0390287 and VNO 0310611 the Judge granted a Take Nothing based on Labor Code Section 3208.3(b) (c) and applicant’s lack of credibility. 

In the case of Jill Guenther v. Nestle U.S.A., Case No. VNO 0344324, VNO 0344345; VNO 0344346; VNO 0344474 Ms. Shah successfully argued no presumption of injury under Labor Code Sections 5401 and 5402 as applicant’s testimony was determined not credible, and defense testimony that applicant had denied industrial injury when questioned about her desire to file a workers’ compensation claim. 

Over the last 20 years with the firm, Ms. Shah has represented several public entities, including the City of Los Angeles and several school districts. 

In the case of Martin Franco v. City of Los Angeles, Case No. VNO 0479008 it was found that applicant, a Police Officer for the City of Los Angeles who filed a claim alleging his colon cancer was related to exposure on the job as a police officer, did not sustain injury as a result of employment with the City. 

Experience: Ms. Shah began her career as an attorney working for the Law Offices of Lloyd Robinson, where she handled civil litigation and applicant workers’ compensation matters. She has been with Kegel, Tobin & Truce since January, 1989.

Education: Preeti earned her B.Com in 1979 from Sydenham College of Commerce and Economics in Bombay, India. She earned her LL.B. from the Government Law College in Bombay, India in 1983.
